1. Scope
This consent applies to:
- Diversified Payday website visitors where applicable
- Customers
- Employer administrators
- Authorized Users
- Individuals authorized to act on behalf of a Customer
This consent applies to all electronic records, disclosures, agreements, notices, acknowledgments, certifications, and signatures relating to Diversified Payday services unless a separate written agreement expressly provides otherwise.
2. Consent to Electronic Communications
By creating an account, accepting an agreement, using the Services, or otherwise interacting with Diversified Payday electronically, you consent to receive communications electronically.
Electronic communications may satisfy legal requirements that a communication be in writing.
3. Electronic Notices
Diversified Payday may provide notices through:
- The payroll platform
- Customer account dashboards
- Public website announcements
- Customer Support
- Secure messages
- Electronic documents
- Other reasonable electronic methods
Diversified Payday is generally not required to send paper copies unless required by law or specifically agreed in writing.
4. Electronic Agreements
The following may be presented electronically:
- Terms and Conditions
- Privacy Policy
- Cookie Policy
- California Privacy Policy
- Refund Policy
- Data Retention Policy
- Acceptable Use Policy
- Future legal policies
- Subscription agreements
- Billing authorizations
- Payroll certifications
- ACH certifications
- User acknowledgments
- Security acknowledgments
- Compliance notices
Electronic presentation has the same force and effect as paper presentation where permitted by law.
5. Electronic Signatures
Electronic signatures include actions such as:
- Clicking an acceptance button
- Selecting an approval checkbox
- Typing a name where requested
- Using an authenticated account to approve an action
- Confirming a certification
- Approving payroll
- Approving a bank file
- Approving billing changes
- Approving tax filings where applicable
- Other authenticated electronic actions intended to indicate agreement
When legally permitted, these actions constitute electronic signatures under applicable electronic-signature laws.
6. Electronic Certifications
Certain actions may require certifications, including:
- Employer bank authorization
- Worker bank authorization
- Payroll approval
- Tax filing authorization
- Subscription changes
- Administrative actions
- Security acknowledgments
- Other compliance-related certifications
Diversified Payday may retain these certifications as part of the Customer's permanent account records.
7. Electronic Records
Diversified Payday maintains electronic records relating to platform activity, including:
- Agreements accepted
- Policy acknowledgments
- Consent records
- Login history
- Administrative actions
- Payroll approvals
- User permissions
- Security events
- Billing activity
- Support communications
- Audit information
Electronic records may be retained according to the Data Retention and Deletion Policy.
8. Record Accuracy
Customers are responsible for reviewing information before electronically approving:
- Payroll
- Tax filings
- Bank information
- Employee records
- Contractor records
- Wage information
- Billing information
- Account settings
Once approved, electronic records may become part of the permanent audit history.
9. Email Address Responsibility
Customers are responsible for maintaining current email addresses and contact information.
Failure to receive an email because contact information is outdated, blocked, filtered, or inaccessible does not invalidate notices that were properly transmitted.
10. Hardware and Software Requirements
To access electronic records, Users generally need:
- Internet access
- A modern web browser
- PDF viewing capability where applicable
- An active email address
- Access to the authenticated account
Requirements may change as technology evolves.
11. Paper Copies
Where permitted by law, electronic records satisfy Diversified Payday's record-delivery obligations.
Customers may print or save electronic documents for their own records.
Diversified Payday is not obligated to provide paper copies unless required by law or specifically agreed.
12. Withdrawal of Consent
A Customer may request to withdraw consent to receive electronic communications.
Withdrawal does not affect:
- Prior electronic agreements
- Prior electronic signatures
- Previously delivered notices
- Existing contractual obligations
Withdrawal may limit or prevent use of portions of the Services that depend upon electronic communications.
Diversified Payday may decline to continue providing Services that cannot reasonably be provided without electronic communications.
13. Updating Contact Information
Customers must promptly update:
- Email addresses
- Telephone numbers
- Mailing addresses
- Authorized contacts
Maintaining current contact information helps ensure timely receipt of notices.
14. Security
Electronic communications may contain sensitive information.
Customers are responsible for:
- Protecting account credentials
- Securing their devices
- Logging out of shared computers
- Using trusted networks
- Reviewing account activity
- Reporting unauthorized access promptly
Diversified Payday uses reasonable administrative, technical, and organizational safeguards but cannot guarantee absolute security.
15. Legal Effect
To the fullest extent permitted by applicable law:
- Electronic records are legally valid.
- Electronic signatures have the same legal effect as handwritten signatures.
- Electronic notices satisfy written-notice requirements.
- Electronic agreements are enforceable.
Nothing in this policy overrides legal requirements that cannot lawfully be modified.
16. Changes to This Consent
Diversified Payday may revise this consent to reflect changes in law, technology, services, or business practices.
The Last Revised date and version number will be updated when changes are published.
Material changes may also be communicated through the website, platform, or account contact information.
